How Partner Visas Work (Two-Stage Pathway)

Partner visas are usually assessed in two stages: first a temporary visa, followed by a permanent stage later.
The pathway you choose depends on whether the applicant is applying onshore (in Australia) or offshore (outside Australia).

Onshore

To qualify for most partner visas, you must be the spouse or de facto partner of an
Australian citizen, Australian permanent resident, or eligible New Zealand citizen, and prove your relationship is
genuine and continuing. Health and character requirements apply.

Onshore Partner Visa (Subclass 820 → 801)

The Subclass 820 is the temporary partner visa for applicants applying in Australia.
The Subclass 801 is the permanent stage, assessed later (Stage 2).

Offshore Partner Visa (Subclass 309 → 100)

The Subclass 309 is the temporary/provisional partner visa generally lodged from outside Australia.
The Subclass 100 is the permanent stage assessed later (Stage 2).

  • Married or de facto relationship with an eligible sponsor
  • Relationship is genuine and continuing

Prospective Marriage Visa (Subclass 300)

The Subclass 300 (fiancé visa) is for couples who intend to marry and then move into a partner visa pathway.
It’s commonly used when you are not yet married and don’t meet de facto evidence requirements.

  • Intend to marry an eligible sponsor
  • Have met and have a genuine relationship
  • Meet health and character requirements

Where you apply

820/801 is generally for applicants applying in Australia. 309/100 is generally for applicants applying from outside Australia.
300 is for couples intending to marry (fiancé pathway).
